Bombay HC Orders BCCI to Pay ₹538 Cr to Kochi Tuskers Kerala

In a major legal setback for the Board of Control for Cricket in India (BCCI), the Bombay High Court has upheld an arbitration award, directing the board to pay ₹538 crore to the now-defunct IPL franchise Kochi Tuskers Kerala. The franchise, which played only one season in 2011, was terminated by the BCCI for allegedly failing to submit a mandatory bank guarantee, an act the board cited as a breach of contract.

This ruling marks the continuation of a decade-long legal battle that began after the termination of the franchise's contract. The Bombay High Court, in its detailed judgment, noted that under Section 34 of the Arbitration and Conciliation Act, the court’s scope for intervention is narrow and does not permit reassessment of the merits of the dispute.

“The BCCI's attempt to revisit the evidence and findings of the arbitral tribunal exceeds the boundaries of judicial review provided under Section 34,” the High Court observed in its ruling, thereby rejecting BCCI’s challenge.

The Kochi franchise, which was bought for a massive ₹1,550 crore in 2010, faced early termination by the BCCI in 2011 due to an alleged payment default. In 2015, an arbitration tribunal ruled in favor of the franchise’s promoters Kochi Cricket Pvt Ltd (KCPL) and Rendezvous Sports directing the BCCI to pay ₹550 crore. The BCCI appealed the arbitration ruling, but the Bombay High Court has now reinforced that decision with a revised penalty of ₹538 crore.

The team featured notable players like Mahela Jayawardene, Brendon McCullum, Brad Hodge, and Ravindra Jadeja. In their lone IPL season, Kochi Tuskers finished eighth in the 10-team league with six wins out of 14 matches.

Following the High Court’s reaffirmation of the arbitral award, BCCI is expected to consult its legal advisors on whether to pursue an appeal in the Supreme Court. The judgment not only sets a precedent in sports contract enforcement but also highlights the financial and legal consequences of abrupt franchise terminations in the IPL ecosystem. This verdict reinforces the principle that arbitration decisions, when conducted within the legal framework, hold binding authority even over India’s most powerful sports body.
