Government Moves to Regulate Online Gaming Amid Rs 20,000 Crore Loss: Online Gaming Bill 2025

The Indian government has introduced the Promotion and Regulation of Online Gaming Bill, 2025 in response to the growing concerns over the online gaming industry, particularly its gambling and betting segments. According to government sources, an estimated 45 crore people in India lose around Rs 20,000 crore annually through online games, including betting and gambling.

The issue has become a "major problem" for the government, with many MPs raising concerns about the financial and mental toll these platforms take on individuals. After deliberating between revenue from online gaming websites and the welfare of citizens, the government opted to address the negative impact of real-money gaming.

The proposed bill highlights several key issues: addiction to gaming, fraudulent activities by operators, and inconsistencies in state laws regarding gambling. Additionally, the bill introduces stricter oversight of online gaming platforms, particularly those that offer money-based games like poker. There are also concerns that these platforms might be used for money laundering or financing terrorism.

A New Legal Framework for Online Gaming

The bill, introduced by Union Electronics and IT Minister Ashwini Vaishnav, outlines penalties for individuals and entities operating illegal gambling apps. Those found guilty could face up to three years in prison, a fine of Rs 1 crore, or both. Advertisers promoting such platforms could face a two-year jail sentence and/or a fine of Rs 50 lakh.

The bill proposes the creation of a national-level Online Gaming Authority, which will regulate digital gaming. This body will categorize and register games, determine which qualify as 'money games', and address complaints from citizens.

Key Provisions: E-Sports, Social Games, and Money Games

The government has emphasized its commitment to promoting e-sports, which it views as an important part of the online gaming industry. E-sports, which involves competitive gaming for prize money, will be granted legal recognition through this bill. Additionally, the government aims to allocate funds to support e-sports development, with a goal of turning India into a global hub for video game development.

Online social games, including multiplayer games like Fortnite, Counter-Strike, and Minecraft, will also be recognized legally. These games, which encourage real-time interaction among players, are expected to be used to promote socio-cultural messages. Developers and promoters of such games could receive financial support from the government.

For online money games, the bill includes strict provisions for action against companies promoting gambling or betting, including penalties for those who advertise such platforms. Celebrities involved in promoting online betting apps are likely to face increased scrutiny.

A Tightening Grip on the Gaming Industry

In addition to the new bill, the government has been taking other measures to regulate the online gaming sector. Since October 2023, a 28% tax has been levied on online gaming activities, with winnings taxed at 30% from the 2024-25 financial year. Offshore gaming platforms have also been brought under the tax net, and over 1,500 illegal gambling sites have been blocked since 2022. As the government takes steps to tighten the screws on the online gaming industry, the Promotion and Regulation of Online Gaming Bill, 2025 marks a significant shift toward regulating gambling and fostering responsible gaming in India.
