Judge blocks Trump White House press ban as lawsuit continues, keeping CNN, MS NOW and Politico journalists able to access the White House while their legal challenge proceeds. The Timothy Kelly ruling extends protection for their White House press credentials as the administration considers its next steps.
White House press credentials
A federal judge has ordered the Trump administration to continue allowing journalists from CNN, MS NOW and Politico into the White House while litigation over their access remains unresolved.
US District Judge Timothy Kelly directed the administration not to enforce its September 18 decision revoking the organisations’ “hard pass” credentials. Those credentials allow reporters regular access to the White House complex without seeking temporary approval for each visit.
Kelly’s earlier temporary protection had been due to expire on October 13. The new order keeps access in place while the court examines whether the administration acted lawfully.
Trump media ban rationale
President Donald Trump has publicly defended the restrictions by pointing to what he considers negative or one-sided coverage of his administration.
Government lawyers offered an additional explanation in court. The Justice Department argued that national security concerns also played a role, citing coverage involving the Iran war, construction in the White House East Wing and the Republican midterm convention.
That difference between Trump’s public explanation and the government’s legal argument has become an important part of the dispute.
Judge questions government case
During an earlier hearing, Kelly questioned why the person who made the decision appeared to give one reason publicly while government attorneys later presented another justification in court.
Justice Department attorney Michael Velchik argued that the president has broad discretion over access to the White House and can remove reporters or organisations from the complex. He also pointed to Trump’s long-running criticism of CNN.
The judge has not yet issued a final ruling on the underlying case, meaning the current order preserves access rather than resolving the dispute completely.
Media outlets challenge ban
Lawyers representing CNN, MS NOW and Politico argue that the restrictions interfere with their ability to cover the president and could discourage other journalists from pursuing critical reporting.
Attorney Ted Boutrous Jr. argued that Trump had repeatedly explained the decision himself and challenged the government’s later effort to rely on different reasoning.
The organisations are seeking continued access while asking the court to review whether the administration can revoke credentials based on its objections to news coverage.
Press access lawsuit
The case could have broader consequences for journalist access rights at the White House. Administrations maintain security authority over the complex, but news organisations argue that access decisions should not become a tool for punishing critical coverage.
The immediate effect of Kelly’s order is clear: CNN, MS NOW and Politico can retain their hard pass credentials while the press access lawsuit moves forward.
A government appeal remains possible. Until the courts issue a final decision, the dispute will continue to test the balance between presidential control of White House access, security considerations and media freedom.
