Applications for the EB-1A employment-based immigrant visa, commonly known as the Einstein visa, have increased sharply as long backlogs continue to affect the broader US immigration system. The EB-1A category, which allows individuals with extraordinary ability to self-petition for permanent residency without employer sponsorship, has attracted growing interest from professionals seeking a faster path to a green card amid delays in other visa routes.
The surge comes at a time when employment-based visa limits are creating extended waiting periods, particularly for applicants from India and China. Although the EB-1A category is designed for individuals who demonstrate exceptional achievements in fields such as science, arts, business, education, or athletics, demand has increasingly outpaced annual visa availability. This imbalance has intensified competition and placed additional pressure on the adjudication process.
Data from US immigration authorities show that EB-1A filings have more than tripled over the past four years. Nearly 7,500 applications were submitted between April and June 2025, compared with approximately 2,500 filings recorded in late 2021. While interest has surged, approval rates have moved in the opposite direction. Approvals have declined from roughly two-thirds of cases to about half, reflecting stricter scrutiny as caseloads grow.
The expanding applicant pool has also fueled a parallel market for services that claim to strengthen visa profiles. Consultants offering resume enhancement, publication assistance, citation inflation, or paid awards have become increasingly visible, particularly among applicants in science and technology sectors. Fees for such services can range from hundreds to several thousand dollars, raising concerns about the authenticity of evidence submitted with some petitions.
Immigration officials have acknowledged that fraudulent or purchased credentials have appeared in a portion of EB-1A filings. Authorities warn that attempts to fabricate achievements or buy recognition undermine the integrity of the visa program and can result in serious consequences. Applications found to contain false information may be denied, and individuals involved risk being barred from future immigration benefits.
In response to rising demand and integrity concerns, US immigration authorities have expanded screening measures and established a new vetting center focused on employment-based petitions. Officials say the effort is intended to strengthen oversight, ensure fairness in adjudications, and protect the credibility of immigrant worker programs. Enhanced review procedures are now a standard part of EB-1A case evaluations.
As interest in the EB-1A visa continues to grow, immigration experts note that legitimate applicants with well-documented, verifiable accomplishments remain eligible for approval. However, the heightened scrutiny signals that the pathway, while still available, has become more complex and competitive. For many professionals navigating the US immigration system, the EB-1A visa represents both opportunity and risk in an environment shaped by high demand, longer waits, and closer examination.
