Judge blocks Trump White House press ban during lawsuit

Judge blocks Trump White House press ban during lawsuit, allowing journalists from CNN, MS NOW and Politico to retain access while their legal challenge proceeds. The Timothy Kelly ruling keeps White House press credentials active as the court examines Trump media restrictions and government justifications.

White House press credentials

A federal judge has ordered the Trump administration to continue allowing journalists from CNN, MS NOW and Politico into the White House while a lawsuit challenging their removal moves through federal court.

US District Judge Timothy Kelly directed the administration not to enforce its September 18, 2026 decision revoking the organisations’ permanent “hard pass” credentials. The passes allow reporters regular entry to the White House complex without having to request temporary access for each visit.

Kelly had previously issued temporary protection for the outlets, but that order was due to expire on October 13. His latest decision keeps the journalists’ access in place while the broader legal questions remain unresolved.

Trump media restrictions

President Donald Trump has repeatedly defended restrictions on the three organisations, arguing that their reporting has been negative or unfair toward his administration.

Justice Department lawyers presented an additional explanation in court, saying national security concerns also influenced the decision. Government attorneys pointed to coverage involving the Iran conflict, construction work in the White House East Wing and the Republican midterm convention.

The difference between Trump’s public explanation and the arguments later offered by government lawyers has become a central issue in the case.

Judge questions government rationale

During a recent hearing, Kelly questioned why the administration appeared to offer different reasons for revoking the credentials.

The judge described it as unusual for the person responsible for a government action to publicly provide one explanation while attorneys later defend that same decision using another rationale.

Justice Department attorney Michael Velchik argued that the president has broad authority over access to the White House. He also noted Trump’s long-running criticism of CNN and maintained that the administration has discretion to determine which reporters receive permanent access.

Media organisations challenge ban

Lawyers representing CNN, MS NOW and Politico argue that the restrictions interfere with their ability to cover the president and could discourage other journalists from publishing critical reporting.

Attorney Ted Boutrous Jr. told the court that Trump had repeatedly explained his decision publicly and argued that those statements should be central to the court’s review.

The outlets contend that press access decisions should not be used to punish organisations because of the tone or content of their reporting.

Federal court lawsuit

The dispute could have broader implications for White House media access and press freedom. Presidents retain significant authority over security inside the White House complex, but courts have previously examined whether credential decisions must follow fair procedures and constitutional protections.

Kelly’s order does not resolve the lawsuit. It simply prevents the administration from enforcing the September ban while the case continues.

A government appeal remains possible. Until a final ruling is issued, journalists from CNN, MS NOW and Politico will continue using their White House hard passes, keeping the legal battle over presidential authority, national security and press access firmly in focus.
