Can an F-1 student start or own a business in the US?

Can an F-1 student start a business in the US? Ownership and employment are separate. F-1 students may pursue entrepreneurship through qualifying OPT, while unauthorized day-to-day work can violate status. STEM OPT startups face additional employer and training requirements.

An F-1 international student may be able to own or invest in a U.S. business, but actively working for that business is a separate immigration issue.

F-1 status places strict limits on employment, making work authorization especially important for students planning a startup.

Can an F-1 student own an LLC?

Holding an ownership interest and performing work are not the same thing. An F-1 student should not assume that creating an LLC automatically authorizes them to manage customers, provide services, make sales or perform other day-to-day work.

ICE warns that unauthorized employment can result in termination of an F-1 student's SEVIS record.

Can an F-1 student start a business on OPT?

Yes, entrepreneurship can be possible under regular Optional Practical Training.

The Department of Homeland Security's Study in the States guidance says F-1 students may start and operate their own business when the activity relates to their program of study and they have been approved for pre-completion or post-completion OPT.

The work must therefore have a direct connection to the student's degree rather than simply being any business opportunity.

What about CPT while studying?

Curricular Practical Training, or CPT, must be an integral part of the student's curriculum. Authorization comes through the school's Designated School Official and must be obtained before the employment begins.

Starting a company does not automatically make its activities eligible for CPT.

STEM OPT has stricter startup rules

Students using the 24-month STEM OPT extension face additional requirements.

The employer must participate in E-Verify, and the student and employer must complete Form I-983 describing the structured training opportunity.

A STEM OPT student can participate in an entrepreneurial venture as an employee, but DHS states that the student cannot act as their own employer or sign the Form I-983 on behalf of the employer.

This means a startup may need another qualified person with authority to represent the employer and supervise the training arrangement.

Can an F-1 student open a convenience store?

An F-1 student may potentially own an interest in a convenience store, but actively running a typical retail store would not automatically qualify as OPT employment.

For OPT, the work must be directly related to the student's field of study. A student should therefore speak with the school's DSO before performing any work for a business they own.

For Indian students considering entrepreneurship in the United States, the safest approach is to separate investment and ownership from active employment and obtain the required authorization before beginning business operations.
