A pending criminal case can affect passport renewal and foreign travel in India, but it does not create one automatic rule for every applicant. Court orders, passport law and immigration decisions operate separately, and additional permission may be required.
A pending criminal case can affect a person's ability to obtain or renew a passport or travel abroad from India, but the result depends on the type of document involved and the orders passed by the court.
Passport renewal and visa renewal are not the same process. A court may impose travel restrictions or require permission before departure, while passport and immigration authorities make separate administrative decisions.
How a criminal case can affect an Indian passport
Under India's passport framework, an applicant with criminal proceedings pending before a court is treated as a complex passport case.
Passport Seva states that cases involving pending criminal proceedings, arrest warrants, summons or court orders prohibiting departure from India require additional scrutiny.
Government rules also require applicants to disclose pending criminal proceedings when seeking passport services.
Can a passport still be issued or renewed?
Yes, in some circumstances.
Government notification GSR 570(E) allows Indian citizens facing pending criminal proceedings to receive a passport when they produce an order from the concerned court permitting them to travel abroad.
The passport's validity may depend on what the court specifies. If the court does not specify a validity period, the passport may generally be issued for one year under the notification.
This means a pending case does not automatically result in a permanent passport ban.
Can a court restrict foreign travel?
Yes.
A criminal court can issue an order prohibiting an accused person from leaving India or can make foreign travel subject to prior permission.
Passport application forms specifically ask whether a court has issued a warrant, summons or an order preventing departure from India.
If such an order exists, the person may need to obtain permission from the court before travelling.
What about visa renewal for foreign nationals?
Visa renewal follows a different process.
A recent example involved Jacqueline Fernandez, who received court clearance to apply for renewal of her Indian employment visa. Read the full Jacqueline Fernandez visa renewal update.
Foreign nationals in India generally deal with the FRRO, FRO or other immigration authorities for visa extension and related services. The Ministry of Home Affairs oversees matters involving entry, stay, visa extension, registration and exit of foreign nationals.
A criminal court does not normally replace the immigration authority's role in deciding a visa application. However, if the applicant is involved in a criminal case and the immigration authority requires court clearance, a court NOC may become necessary before the visa request can proceed.
The type of clearance required can vary depending on the visa service and the applicant’s legal circumstances. Read what an FRRO NOC is and when it may be required in India.
Court permission does not guarantee renewal
Foreign nationals involved in criminal proceedings may still be able to seek visa renewal, but additional legal and immigration requirements can apply. Read how Indian work visa renewal may work during a pending criminal case.
Receiving court permission to apply for a passport or visa-related service is not the same as receiving final approval. Read how passport release, visa renewal and court permission differ in India.
Passport authorities and immigration authorities must still examine the application under the applicable laws and procedures.
The practical result therefore depends on the pending case, existing court orders, travel restrictions and the type of passport or visa service being requested.
