Can Foreign Nationals Renew an Indian Work Visa During a Court Case?

Foreign nationals facing criminal proceedings in India may still be able to seek renewal of an employment visa, but approval is not automatic. FRRO authorities examine eligibility, documents and applicable restrictions, while some cases may require separate court clearance.

A pending criminal case in India does not necessarily mean that a foreign national is automatically barred from applying to renew an employment visa. However, the application can become more complicated when court orders, passport restrictions or other legal conditions are involved.

Visa renewal remains an immigration decision, while courts separately control matters connected to criminal proceedings.

How Indian work visa renewal works

Foreign nationals seeking visa extension and other immigration services generally use India's e-FRRO system.

The portal handles services including visa extension, registration, visa conversion and exit permits. Applications are scrutinized by visa officers, who may request additional documents or verification before granting or rejecting the requested service.

Employment visas may also be extended by FRRO or FRO authorities subject to applicable eligibility requirements, supporting employment documents and other conditions. Government guidance has included factors such as continued employment, tax compliance, good conduct and the absence of adverse security inputs.

Does a criminal case automatically block renewal?

Not necessarily.

A pending criminal proceeding and an immigration application are separate legal processes. Whether a visa can be renewed depends on the applicant's circumstances, any court restrictions and the decision of the competent immigration authority.

If a passport has been deposited with a court, foreign travel has been restricted or an authority requires judicial clearance, the applicant may first need permission from the relevant court.

When can a court NOC become necessary?

A court NOC can become relevant when immigration authorities require confirmation that the court handling a criminal case has no objection to the applicant proceeding with a visa-related request.

Jacqueline Fernandez's case provides a current example. On October 6, 2026, a Delhi court granted the Sri Lankan actor an NOC enabling her to apply for renewal of her employment visa after her counsel said the FRRO would not process the renewal without court clearance.

The court did not itself renew her visa.

Court permission is not visa approval

This distinction is important.

In Fernandez's case, the court specifically said the concerned authority should consider her visa application independently under applicable laws and rules.

That means receiving an NOC removes one procedural obstacle but does not guarantee that the FRRO will approve the visa extension.

What should foreign nationals check?

Foreign nationals involved in legal proceedings should check whether any court order affects their passport, travel or immigration status before applying for renewal.

They should also follow the document requirements for their particular e-FRRO service. The Ministry of Home Affairs advises foreign nationals to approach the appropriate FRRO or FRO for visa-related services, including cases requiring consideration beyond routinely delegated powers.

Ultimately, work visa renewal during a pending criminal case is a case-specific process. The existence of a case may create additional requirements, but the final immigration decision remains with the competent authority.
