If an Indian visa expires before an extension is approved, a pending application does not automatically guarantee permission to stay. Learn how to check e-FRRO status, contact immigration authorities and address potential overstay issues.
A foreign national involved in ongoing court proceedings in India still has to maintain valid immigration status. A pending criminal case does not automatically extend an Indian visa or suspend its expiry date.
If the visa expires while the case is continuing, the foreign national may need to seek an extension, regularization of the overstay or another immigration service through the appropriate FRRO or FRO.
Does a court case automatically extend a visa?
No.
Court proceedings and immigration status operate separately. A court may require an accused person to remain available for hearings or may restrict foreign travel, but that does not by itself renew or extend a visa.

India's e-FRRO system handles services including visa extension, visa conversion and exit permits for foreign nationals. Authorities advise applicants to apply in advance rather than wait until a visa has already expired.
What happens after the visa expires?
Remaining in India beyond the permitted visa period can amount to an overstay.
Under India's current immigration framework, overstaying a visa can result in financial penalties and, depending on the circumstances, further legal action. The Immigration and Foreigners Act, 2025 provides penalties for remaining in India beyond the authorized visa period.
For most foreign nationals, the current compounding amounts listed for overstay range from ₹10,000 for up to 30 days to higher amounts for longer periods.

The Ministry of Home Affairs is responsible for visa extensions, immigration, registration, stay and exit of foreign nationals in India.
How can a pending court case affect the process?
A court case can make the immigration process more complicated.
If a court has restricted foreign travel, retained a passport or required prior permission to leave India, the foreign national may need judicial clearance in addition to immigration approval.
Immigration authorities can also consider whether a court case, lookout notice or other legal restriction affects an exit or visa-related request.
Older Ministry guidance on FRRO powers specifically recognized that exit permission and overstay regularization could depend on the absence of a local objection, lookout circular or relevant pending court case.
Can the person simply leave India after the visa expires?
Not always.
A foreign national who has overstayed may need an exit permit or regularization before departure. If a court has separately restricted travel, court permission may also be required.
Departure may involve another layer of legal and immigration checks when criminal proceedings are still pending. Read whether foreigners can travel abroad during a criminal case in India.
The e-FRRO system specifically lists exit permits among the immigration services available to foreign nationals.
The safest approach is to address visa expiry before it becomes an overstay. A pending court case does not cancel immigration obligations, and both the FRRO/FRO requirements and any court-imposed conditions must be dealt with separately.
