Can Families Get Compensation After a U.S. Student Crash?

Last Updated: July 20, 2026

Family compensation after a U.S. student crash may be available when another driver or responsible party caused the death. This guide explains liability insurance, wrongful-death claims, uninsured motorist coverage, funeral costs and the steps an Indian family may need to take.

When an Indian student dies in a U.S. car crash without causing the collision, the family may be able to seek compensation. However, payment is not automatic. It depends on the police investigation, state law, available insurance and who is legally authorized to act for the student’s estate.

At-Fault Driver Insurance

Before filing a claim, families may need to understand what happens when an Indian student dies in a U.S. car crash, including the police investigation, medical examiner process and release of remains.

When another driver is found responsible, that driver’s liability insurance may cover legally recoverable losses. These can include medical expenses incurred before death, funeral costs and compensation available through a wrongful-death or estate claim.

Insurance payments are limited by the policy’s coverage limits. When the losses exceed those limits, additional recovery may depend on other insurance or the responsible party’s assets.

Wrongful Death Compensation

A wrongful-death claim may be available when negligence or another wrongful act caused the student’s death. The claim is generally filed by a personal representative or an eligible family member, depending on the state.

Recoverable damages vary considerably. They may include financial losses suffered by eligible relatives and certain funeral or related expenses. Parents living in India are not automatically disqualified, but they may need U.S. legal documents establishing their authority or beneficiary status.

Uninsured Motorist Coverage

If the responsible driver was uninsured, fled the scene or lacked sufficient coverage, uninsured or underinsured motorist insurance may provide another source of payment. The National Association of Insurance Commissioners explains that uninsured motorist coverage can apply when an uninsured or hit-and-run driver causes the loss, while underinsured coverage may apply when the responsible driver’s limits are insufficient.

The coverage may come from the vehicle in which the student was traveling or another applicable policy. Availability and policy requirements differ by state.

Benefits From the Student’s Policies

Families should also check whether Indian students in the U.S. have insurance, because university, private and travel policies may provide different benefits.

Separate benefits may also be available through accidental-death insurance, travel insurance, university-sponsored coverage or a policy that includes repatriation. These benefits may be payable regardless of which driver caused the crash, but only when the policy terms cover the incident.

Health insurance alone should not be assumed to provide a death payment or cover transportation of remains.

Steps the Family May Need to Take

If the crash involved a hired vehicle, available compensation may also depend on the rental agreement and optional coverage. See the rental car insurance guide for Indian students in the U.S.

The family should obtain the police report, death certificate, insurance details and information about every vehicle involved. A representative may need to open an estate or obtain legal authority in the state where the claim is handled.

Because deadlines and eligible claimants vary by state, the family may need advice from a licensed attorney and direct confirmation from each insurer. Compensation normally depends on documented liability, coverage and financial loss rather than the student’s nationality or visa status.

If investigators find that the student caused the collision, the family’s position may be different. Read who pays after an international student causes a fatal U.S. crash for an explanation of insurance, estate claims and family liability.
